4. The organization of the provision of high-tech medical care is carried out using specialized information system in the manner established by the Ministry of Health of the Russian Federation in accordance with Part 8 of Article 34 of the Federal Law of November 21, 2011 N 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” (Collected Legislation of the Russian Federation, 2011, N 48, Art. 6724).

5. The procedure for referring patients to medical organizations subordinate to federal executive authorities (hereinafter referred to as the federal medical organization) for the provision of specialized (with the exception of high-tech) medical care is established by the appendix to this Regulation.

The referral of citizens entitled to receive state social assistance in the form of a set of social services to provide specialized (with the exception of high-tech) medical care in federal medical organizations is carried out in accordance with the order of the Ministry of Health and Social Development of the Russian Federation dated October 5, 2005 N 617 “On the Procedure for Referring Citizens by Executive Authorities of the Subjects of the Russian Federation in the Sphere of Healthcare to the Place of Treatment in the Presence of Medical Indications” (registered by the Ministry of Justice of the Russian Federation on October 27, 2005, registration No. 7115).

6. Specialized, including high-tech, medical care is organized and provided in accordance with the procedures for providing medical care, mandatory for all medical organizations on the territory of the Russian Federation, as well as on the basis of standards of medical care.

7. Specialized, including high-tech, medical care is provided in the following conditions:

in a day hospital (in conditions that provide medical supervision and treatment during the day, but do not require round-the-clock medical supervision and treatment);

inpatient (in conditions that provide round-the-clock medical supervision and treatment).

8. When organizing the provision of specialized, including high-tech, medical care, medical records and reports are maintained.

9. Medical indications for the provision of specialized, including high-tech, medical care in a hospital setting are:

a) the presence or suspicion of the patient having a disease and (or) condition that requires the provision of specialized, including high-tech, emergency or emergency medical care for the purpose of diagnosis and treatment;

b) the presence or suspicion of the patient having a disease and (or) condition that requires the provision of specialized, including high-tech, medical care in a planned form for the purposes of prevention, diagnosis, treatment, rehabilitation;

c) the presence or suspicion of the patient having a disease and (or) condition that poses a threat to the life and health of others (isolation of the patient, including for epidemic reasons);

d) the risk of complications when a patient undergoes medical interventions related to diagnosis and treatment;

e) the inability to provide specialized, including high-tech, medical care in a day hospital due to the patient’s age (children, elderly citizens) and group 1 disability.

10. Medical indications for the provision of specialized, including high-tech, medical care in a day hospital are the presence or suspicion of the patient having a disease and (or) condition that requires the provision of specialized, including high-tech, medical care in a planned form for the purpose of prevention, diagnosis, treatment, rehabilitation.

11. Determining the presence of one or more medical indications for the provision of specialized medical care (with the exception of high-tech) in a planned form in an inpatient setting or in a day hospital setting, provided for in subparagraph “b” of paragraph 9 and paragraph 10 of these Regulations, is carried out by the attending physician.

12. Determination of the presence of medical indications for the provision of high-tech medical care in a planned form, provided for in subparagraph “b” of paragraph 9 and paragraph 10 of these Regulations, is carried out by the medical commission of the medical organization in which the patient is provided with primary specialized health care or specialized medical care, with taking into account the list of types of high-tech medical care established by the program of state guarantees of free medical care to citizens *(2). The decision of the medical commission of the medical organization is documented in a protocol with an entry in the patient’s medical records.

13. To receive specialized medical care in an emergency or emergency form, the patient independently turns to a medical organization or is delivered by a mobile ambulance team in accordance with the Rules for medical evacuation when providing emergency medical care *(3) .

When providing specialized emergency medical care, the time from the moment the patient is delivered by a mobile ambulance team to a medical organization or from the moment the patient independently contacts a medical organization until a preliminary diagnosis is established should not exceed 1 hour.

14. In the event of a patient’s independent appeal to a medical organization providing specialized medical care, the determination of medical indications for the provision of specialized medical care on an inpatient basis, provided for in subparagraph “a” of paragraph 9 of these Regulations, is carried out by a specialist doctor (specialist doctors) of this medical organization with registration entries in the records of the medical organization and the medical records of the patient.

15. In the absence of medical indications for the provision of specialized medical care in a hospital setting, provided for in subparagraph “a” of paragraph 9 of these Regulations, or the patient refuses to provide specialized medical care in an emergency or emergency form, a specialist doctor of a medical organization providing specialized medical care, draws up a medical report on the letterhead of a medical organization containing:

date and time of patient admission;

the procedure for the patient’s admission (self-referral, delivery by a mobile ambulance team, referral by a medical organization);

last name, first name, patronymic (if any) of the patient and his date of birth (date, month, year);

diagnosis of the disease (condition) and code according to ICD-10 *(4);

list, scope and results of medical interventions performed on the patient in order to determine medical indications for the provision of specialized medical care;

reason for refusal of hospitalization (lack of medical indications, patient refusal);

16. If a patient refuses hospitalization if there are medical indications for the provision of specialized medical care in an emergency or emergency form, the medical specialist of the medical organization providing specialized medical care provides explanations to the patient (the patient’s legal representative) about the possible consequences of this refusal for the state of health and life of the patient in compliance with the requirements *(5) established by the legislation of the Russian Federation.

17. To receive specialized medical care in a planned form, the choice of a medical organization is carried out on the direction of the attending physician.

If several medical organizations providing medical care in the relevant profile take part in the implementation of the territorial program of state guarantees of free medical care to citizens (hereinafter referred to as the territorial program), the attending physician is obliged to inform the patient (the patient’s legal representative) about the possibility of choosing a medical organization in the established order*(6) taking into account the fulfillment of the conditions for the provision of medical care established by the territorial program.

18. If a patient has medical indications for the provision of specialized medical care, the attending physician prepares an extract from the patient’s medical records in accordance with the requirements provided for in paragraph 19 of this Procedure, and a referral for hospitalization to a medical organization providing specialized medical care (hereinafter referred to as a referral for hospitalization), in accordance with the requirements provided for in paragraph 20 of this Procedure.

An extract from the medical documentation and a referral for hospitalization is issued to the patient (his legal representative).

19. An extract from the medical documentation must contain the diagnosis of the disease (condition), diagnosis code according to ICD-10, information about the state of health, diagnosis and treatment, recommendations on the need for specialized medical care, indicating the form of its provision (emergency, planned).

20. A referral for hospitalization is issued by the attending physician on the letterhead of the medical organization, must be legibly written by hand or in printed form, certified by the personal signature and seal of the attending physician and contain the following information:

last name, first name, patronymic (if any) of the patient, date of birth, home address;

insurance policy number and name of the insurance organization (if any);

certificate of compulsory pension insurance

(in the presence of);

results of laboratory, instrumental and other types of diagnostics confirming the established diagnosis and the presence of medical indications for the provision of specialized medical care;

the profile of specialized medical care indicated to the patient and the conditions for its provision (inpatient, in a day hospital);

name of the medical organization to which the patient is sent for specialized medical care;

last name, first name, patronymic (if available) and position of the attending physician, contact phone number (if available), email address (if available).

21. The choice of a medical organization when providing a patient with specialized medical care in a planned form outside the territory of the subject of the Russian Federation in which the patient lives is carried out in accordance with the order of the Ministry of Health of the Russian Federation dated December 21, 2012 N 1342n “On approval of the Procedure for a citizen’s choice of medical organizations (except for cases of emergency medical care) outside the territory of the subject of the Russian Federation in which a citizen lives, when providing him with medical care within the framework of the program of state guarantees of free medical care" (registered by the Ministry of Justice of the Russian Federation on March 12, 2013, registration N 27617).

22. A necessary precondition for medical intervention in the provision of specialized, including high-tech, medical care is the giving of informed voluntary consent of a citizen or his legal representative to medical intervention on the basis of complete information provided by a medical worker in an accessible form about the goals, methods of providing medical care, related at risk with them, possible options medical intervention, its consequences, as well as the expected results of medical care.

13. The protocol of the decision of the medical commission of the federal medical organization is drawn up on paper in one copy and stored in the federal medical organization.

14. The medical commission of the federal medical organization, in the event of making one of the decisions specified in subparagraph “e” of paragraph 12 of this Procedure, notifies using available means of communication (telephone, telephone/fax, Email etc.) the referring medical organization or the Ministry of Health of the Russian Federation when sending patients to provide specialized medical care in the cases specified in paragraph 16 of this Procedure, about their decision within a period not exceeding three working days from the date of its adoption, with the sending of an extract from protocol of the decision of the medical commission of the federal medical organization through electronic interaction.

15. The executive body of the constituent entity of the Russian Federation in the field of healthcare, if the medical commission of the federal medical organization makes the decision specified in paragraph three of subparagraph “e” of paragraph 12 of this Procedure, provides further treatment of the patient in accordance with the recommendations specified in the extract from the protocol of the medical decision commission of the federal medical organization, in the volumes provided for by the territorial program of state guarantees of free medical care to citizens.

16. The Ministry of Health of the Russian Federation (hereinafter referred to as the Ministry) refers patients to provide specialized medical care to federal medical organizations in cases where:

1) the patient does not have registration at the place of residence (temporary residence or stay) on the territory of the Russian Federation;

2) the executive authority of the constituent entity of the Russian Federation in the field of healthcare at the place of residence (temporary residence or stay) of the patient did not ensure the referral of the patient to a federal medical organization for the provision of specialized medical care in accordance with this Procedure.

17. The basis for referral by the Ministry (an authorized structural unit of the Ministry) of a patient to a federal medical organization for the provision of specialized medical care is a written application from the patient (his legal representative) to the Ministry with information about the reasons for contacting the Ministry for the purpose of referral to a federal medical organization for the provision of specialized medical care.

a) a copy of the passport of the patient’s legal representative;

b) a copy of a document confirming the authority of the patient’s legal representative.

21. The authorized structural unit of the Ministry, within ten working days from the date of registration with the Ministry of the written request of the patient (his legal representative) and the copies of documents attached to it, provided for in paragraphs 19 and of this Procedure, ensures the sending of a written request to the federal medical organization and a copy of the notification to the patient about the need to determine the presence (absence) of medical indications for providing the patient with specialized medical care in a federal medical organization, attaching copies of the documents specified in paragraph 19 of this Procedure.

22. In the absence of one or more copies of the documents provided for in subparagraphs “a” - “d” of paragraph 19 of this Procedure, the authorized structural unit of the Ministry within 2 working days prepares a written response to the patient (his legal representative) signed by the authorized director structural unit Ministry (the person replacing him) with an explanation of the list of documents required to refer a patient to a federal medical organization for the provision of specialized medical care.

23. The medical commission of the federal medical organization, in the event of making one of the decisions specified in subparagraph "e" of paragraph 12 of this Procedure, notifies using available means of communication (telephone, telephone/fax, e-mail, etc.) the authorized structural unit of the Ministry about its decision within a period not exceeding three working days from the date of its adoption, with the sending of an extract from the protocol of the decision of the medical commission of the federal medical organization to the authorized structural unit of the Ministry and the patient (his legal representative).

24. The patient has the right to appeal decisions made during his referral to a federal medical organization for the provision of specialized medical care at any stage, as well as the actions (inaction) of bodies, organizations, officials and other persons in the manner established by the legislation of the Russian Federation.
